                     How to buy a home in Spain step by step

1.1 The Land Registry

Its functions include expressing the content of the Register, through which we can find out the legal situation of the home. The consumer can request the issuance of a simple note or certification of domain and charges or the mere verbal consultation of the Registrar.

1.1.1 The simple informative note

It is the most frequent, fast and cheap way to know the contents of the registry,

The consumer will know the description of the house, surface, property quota, mortgages, embargoes, tax conditions and in general the information necessary for the purchase operation.

The simple note can be requested directly from the Registrar in whose jurisdiction the property is located.

The simple note is more limited than the certification note, since it has purely informative content, does not attest to the content of the Registry entries, and does not produce effects against a third party as it is a private document. In important operations such as buying a home, it is advisable to request a certification.

1.1.2 The certification of domain and loads

It guarantees under the sole Registrar,s faith and responsibility that the certification fully coincides with the content of the registry entries. It has the character of a public document, unlike the single note, which is a private document without proof.

1.1.3 The Registrar,s Report

The consumer may also request in writing that the Registrar issue a report, binding or not, explaining the legal status of a property registry. It is done in writing.

1.1.4 Verbal counseling

The Registrar is obliged to verbally inform any person who requests it, advising them, on matters related to registration. Verbal information is free.

1.2 The notary

Its main function is to give authenticity and strength to the declarations of will of the parties in the public instrument drawn up in accordance with the laws. The notarial deed is the ordinary means for the home purchase to have access to the Purchase Register.

1.4 The lawyer

The Lawyer is a free professional collegiate whose legal information makes him especially useful in advising the part that hires him, studying the business under the most favorable profile to that part. The choice is free and your fees are for the account of the person who hires you.

1.5 The seller

The seller who is a property developer is legally obliged to provide buyers with extensive information on the characteristics and conditions of the construction, being bound by the advertising they carry out. This without prejudice to the documents that must be made available to the buyer, to which we will later refer.
